EVICTIONS
An eviction, or forcible entry and detainer action (“FED”), is a judicial process by which a landlord may take back possession of real property which is occupied by others. Eviction suits are brought in the city municipal court in which the property is located. An owner’s primary objective is to obtain a writ of restitution for possession and a judgment against the tenant for monetary damages including attorney’s fees, costs and unpaid rent. Evictions are typically filed to remove tenants who have failed to pay rent, but are also filed to remove tenants after a foreclosure, or tenants causing damage to the property or violating terms of the written lease. The steps in the eviction process include:
- Posting a three (3) day Notice to Vacate Premises on the tenant’s door
- Filing the Forcible Entry and Detainer complaint with the Court
- Attending the eviction hearing in Municipal Court
- Receiving the Writ of Restitution and Judgment Entry for monetary damages
- Sheriff posts notice on tenants door specifying the move out date
- Sheriff supervises the move out and physically removes tenant if necessary
